Terms and Privacy

This is the whole agreement between you and FrankVenture LLC, which owns and operates GoNoGo WX Boating at gonogowx.com (the “Service”). It replaces the separate Terms of Service, Privacy Policy and Cookie Policy, which said the same things in three places. Using the Service means you agree to it. You need to be at least 18.

What we collect, and what we do with it

This is everything we collect:

• Your account: a name or display name, your email address, and a hashed password. We never store your password in readable form.
• Your boat and your limits: the vessel profile and the threshold numbers you set. This is what makes a briefing yours rather than a forecast.
• Places, which is location data: your home port, your Saved Waters and planned destinations, and any coordinates or place names you type in to get a briefing. We use them to fetch conditions for those places.
• Float plan details: the people aboard, and the names, phone numbers and emails of your shore contacts and of anyone you list to call if you are overdue, along with the route, times and safety gear on the plan. We use them to build the float plan and to send it and its check-in reminders to the people you name. You confirm the people you name as shore contacts or crew have agreed to be named and emailed.
• Your usual crew list: the names and phone numbers of people who regularly come along, so a float plan is not retyped each time.
• What identifies your boat: its MMSI, registration or documentation number, call sign, colors, make and model, a photo link if you add one, and your phone on board. They are printed on the float plan. A float plan with an MMSI links to VesselFinder, which receives the MMSI when your contact opens it.
• Fair use of the free trial: when a trial account sets up its boat, we keep a scrambled fingerprint of the boat (its MMSI, or its name, length and home port) so one boat does not start a second free trial. We store only a one-way hash, never the name, number or place itself, and we keep it for three years.
• Saved trips: routes you save to run again, with their names, waypoints and usual departure hour. They hold no weather and are kept until you delete them.
• Your Virtual First Mate questions: what you ask it, and a trip you describe in your own words. They are sent, with your briefing and your boat, to Anthropic to write the answer (see below).
• Your subscription: if you subscribe, the payment processor’s customer and subscription references, and a record of your agreement to the automatic renewal: when you agreed, what you were shown, and the IP address and browser you agreed from. We never see or store your full card number.
• Usage and device data: basic server logs, and, only if you consent, product analytics.
• Whether you opened the daily briefing: the email carries a small invisible image and its link is counted, so we can see whether the briefing is being read at all. We keep the first open and the first click per day and nothing else: no record of how long you looked, how many times you came back, what device you were on, or where you were.

We use all of it to run the Service: to produce your briefings, keep your profile across sessions, operate your account, take payment, send you the email you asked for, keep the Service secure, and to understand how the product is used and how well our marketing works, so we can make it better. That last one includes analytics and marketing metrics, and we would rather say so plainly than bury it.

What we never do

We never sell your information. Not to anyone, not in any form, not under any other name for it. We do not share it with advertisers or data brokers, we run no cross-site advertising trackers, no retargeting pixels and no ad cookies, and we do not use your saved places to build a profile of you for anybody else.

Who else touches it

Only these providers, and only as far as each one needs to:

• our hosting provider, Cloudflare, which also runs the check on the sign-up form that tells people from bots;
• our weather and water sources, the National Weather Service and NOAA, and Open-Meteo, which receive the coordinates of the places we look up; NOAA’s radar service is contacted by your browser directly when a map shows rain;
• the U.S. Army Corps of Engineers channel data, hosted by Esri, which receives the area around a route you plan so we can name the channels on it;
• OpenStreetMap’s place search, which receives a place name or ZIP code when you look one up, on some screens straight from your browser;
• Anthropic, which writes the Virtual First Mate’s answers and some briefing sentences from your briefing, your boat and your question;
• VesselFinder, a public ship-tracking map, which receives a boat’s MMSI when somebody holding its float plan opens the AIS link on it;
• our email provider, Resend, which delivers every email we send, including float plans to your shore contacts;
• our analytics provider, PostHog, and only if you consent;
• our payment processor, Stripe, which handles card data so that we never hold a full card number; and
• our own error monitoring, run by FrankVenture LLC, which records what went wrong and may record the account it happened on.

Stripe, Resend, PostHog, Anthropic and Cloudflare act for us under contract.

We disclose information otherwise only where the law requires it or to protect someone’s safety.

What we put on your device

• A session cookie (gng_session), signed and httpOnly, which keeps you signed in. It is strictly necessary and cannot be switched off while you are using an account.
• A device cookie (gng_device), set when you sign up, httpOnly, first-party and kept up to 400 days. It holds a random number and nothing about you, and its only purpose is fair use of the free trial, so one person or boat does not start a second free trial. We store only a one-way hash of it, with the account whose trial it carried, and we count trials started from the same network over 90 days, also as a hash. That count alone never refuses anyone.
• Local storage for your preferences and your cookie choice. It stays on your device and is not used to follow you anywhere.
• Analytics, only if you accept. A random identifier in your browser’s local storage, so that a signup and a briefing can be counted as one visit rather than two. Nothing is sent unless you say yes, the counting happens on our own server, the figures reach PostHog in the United States with no name, email or address attached. We treat Global Privacy Control and Do Not Track as a no to analytics. Turning analytics off in your account settings erases the identifier.
• Page counts by our host, for every visitor. Cloudflare, which hosts the site, counts page views with its Web Analytics. It sets no cookie, stores nothing in your browser and gives you no identifier, so it cannot tell one visitor from another or follow you between sites. It records the page, the site that sent you, your browser type, your country and how long the page took to load. Your IP address reaches Cloudflare so it can tell your country; Cloudflare says it does not store it. Your choice about analytics above does not change it.

Change your mind whenever you like, from the cookie banner or your browser settings. Blocking the session cookie will sign you out.

Your data, your choice

• Download everything we hold on you as a file, from the “Your data” card in Settings: your account, your boat and limits, your float plan contacts and crew, your Saved Waters and your saved trips.
• Delete your account from the same card, yourself, in one place. It erases your profile, your boat and limits, your float plan contacts and crew, your Saved Waters and your saved trips, stops the briefing and releases your email address. If you have a subscription it is canceled first, and if that cancellation fails we delete nothing and tell you so.
• See or correct your account information in settings, or ask us and we will do it.
• Unsubscribe from product and marketing email with the link in any of them. Every send carries one.
• Manage analytics consent from the cookie banner at any time.
• Depending on where you live (California, Virginia, Colorado, Connecticut, Utah, the EU and UK among others) you may have further rights to access, delete or port your data and to opt out of certain processing. Ask us and we will honor them.

We keep your information while your account is active and as long as the law requires, then delete or anonymize it. A few things outlive a deletion for a short while and it is fairer to say so than to imply otherwise: a briefing or share link you generated is cached against an opaque id with no route back to your account, the record of whether a briefing was opened is kept by day, and a float plan you emailed to a shore contact stays readable at the link they were sent. None carries your name in the address, we cannot look any of them up by account, and all expire on their own: cached briefings within 30 days and open counts within 90. The free-trial records also stay for their set periods after a deletion, so the one-trial rule still holds: the scrambled boat fingerprint for 3 years, the device record for 400 days and the network count for 90 days. A plan you build and do not send is deleted after 48 hours. A float plan you sent stays readable at its link until 7 days after the time the plan says to treat the boat as overdue, then it is deleted. We protect what we hold with reasonable technical and organizational measures, though no method is perfect. The Service is not for children under 18 and we do not knowingly collect their information; tell us if you think we have and we will delete it.

Using the Service

GoNoGo WX Boating produces go/no-go briefings for time on the water against thresholds you set. We may add, change or drop features. You are responsible for your password and for what happens under your account, and for giving us accurate information.

Reference use only. Everything the Service produces (briefings, outlooks, plans, float plans, diagrams and text) is for reference and situational awareness. None of it is certified for navigation or a substitute for your own judgment, and it must be used alongside official charts, publications, briefings and instruments.

What an assessment describes. The day score and every assessment, whether GO, CAUTION or NO-GO, describe how the conditions fit the limits you set. They describe fit, not safety.

Planning figures and charts. Distances, times and routes are for planning; navigate by your chart and plotter. Charts shown in the Service are for reference only and are not for navigation.

Harbor and refuge information. Places to get in along a route come from open map data and may be incomplete, including on depths, fuel, transient slips, bars and whether anyone is on the dock.

If you are on the water, you are the operator and solely responsible for the safe conduct of the voyage, for the Navigation Rules (COLREGS) and every applicable law, and for monitoring VHF weather, marine warnings, local advisories and your own observations.

Float plans are not monitored. GoNoGo WX Boating does not watch your trip and never contacts anyone if you are overdue. Your shore contact does that, using the time on the plan. Check-in reminders go by email and can be late or fail to arrive.

You use the Service at your sole risk and you assume that risk, along with the risk of any decision you make, or fail to make, in connection with it.

Sharing a briefing. Your subscription is for you. You may forward an individual briefing, or share a briefing link, with a small number of people who have a genuine interest in that trip, such as your crew, your family or a shore contact. A shared briefing link opens for at most 3 distinct people and then asks the next reader to sign up. You may not redistribute briefings to a mailing list, a forum, a group chat of strangers, a club roster, or any audience beyond that, and you may not republish them commercially. A briefing is scored against one boat and one set of limits, so it is not a general forecast and is not accurate for anyone else’s vessel. If sharing goes beyond this, we may limit access, and we would rather talk to you about a plan that fits.

You agree not to:

• use the Service unlawfully or against these terms;
• use it as a primary means of navigation, or for any safety-critical purpose it is not built for;
• scrape, resell or redistribute it or its data without permission, or share briefings beyond what “Sharing a briefing” above allows;
• interfere with it, overload it, or try to reach parts of it you are not entitled to; or
• make it the sole basis of a safety-critical decision.

Where the data comes from

The Service depends on third-party data and providers, and we do not control the accuracy, availability, completeness, timeliness or formatting of anything they publish. We do not promise that the original sources, the National Weather Service included, have given us data that is accurate, complete, timely or properly formatted. Data can be delayed or incomplete, and a forecast is a forecast whoever publishes it.

Some of what we say is drawn from published navigational references such as the US Coast Pilot, and where it is, we cite the volume and paragraph so you can look it up. We work from the most current edition available to us, but editions and weekly corrections come out on the publisher’s schedule rather than ours, and we do not promise that a citation reflects the latest edition or that the reference is still correct. Shoals, bars and channels move between surveys. Nothing cited here replaces current charts, Local Notices to Mariners, or your own judgment.

The main sources are the National Weather Service and NOAA (forecasts, buoys, tides and currents, charts), Open-Meteo, and OpenStreetMap. Sources whose licenses require credit are listed at Data sources. None of those sources endorse GoNoGo WX Boating or checked our arithmetic.

Subscriptions

The trial. A new account gets a 7-day free trial of the whole Service, with no card required. When your trial ends, your boat, limits and saved places are kept, ready the moment you subscribe. Briefings, planning and alerts pause until then, and check-in reminders for a float plan you already sent keep going. If you subscribe during your trial, your first charge is on the day it ends. Cancel in Settings before that date and you will not be charged. One free trial per person and boat; we may end a repeat trial and ask you to subscribe.

The subscription renews automatically. There is one subscription, and it is annual: $149 a year. A subscription started through 11:59 pm Eastern, October 30, 2026 pays the founding rate of $99 for its first year only. When you subscribe, it automatically renews every year at the end of each term, and at each renewal we charge the card on file. Renewals are $149 a year. If we change the price, we will email you at least 30 days before the renewal it applies to, and you can cancel before then. The price you will be charged, and the date of your next renewal, are shown to you before you subscribe, again in the acknowledgment email we send when you do, and at any time in Settings. We also email you at least 15 days before each renewal.

It continues until you cancel. There is no separate step to keep your subscription; it runs until you stop it. You can cancel at any time, online and in one place, from Settings. Canceling takes effect at the end of the period you have already paid for: it stops all future charges, and your access runs to the end of that period. To avoid being charged for the next term, cancel before the renewal date shown in Settings.

Refunds. Your first charge is not refundable, so use the free days to decide. If a later renewal charge takes you by surprise, write to us at support@gonogowx.com within 14 days of the charge and we will refund it. This does not limit rights you have under the law of your state.

If we discontinue the Service. We may stop offering GoNoGo WX Boating. If we do, we will tell you by email at least 30 days before the shutdown date, your access continues until that date, and we will refund the unused portion of anything you have already paid, pro rata to the day we stop. You do not need to ask: the refund goes back to the card the charge came from, and if that card no longer works we will write to you to arrange it. We will also cancel all future billing at the same time, so there is no renewal to catch. Before the shutdown date you can export your data from Settings.

What you own stays yours: the thresholds and data you enter are your property, and the Service itself, its software, design and content, is ours, licensed to you for personal, non-commercial use and revocable if you break these terms.

Disclaimer of warranties

THE SERVICE, AND ALL DATA, BRIEFINGS, OUTLOOKS AND CONTENT AVAILABLE THROUGH IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY BRIEFING OR DATUM IS ACCURATE, COMPLETE, TIMELY OR CURRENT, OR THAT THE ORIGINAL DATA SOURCES (INCLUDING THE NATIONAL WEATHER SERVICE) HAVE PROVIDED DATA THAT IS ACCURATE, COMPLETE, TIMELY OR PROPERLY FORMATTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THIS MAY NOT APPLY TO YOU.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FRANKVENTURE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PROPERTY (INCLUDING ANY VESSEL), PERSONAL INJURY OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY DECISION YOU MAKE BASED ON IT, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED DOLLARS ($100.00). You acknowledge that this allocation of risk is a basis of the bargain and reflects the fees charged.

Some jurisdictions do not allow the exclusion or limitation of liability for personal injury, death, gross negligence or willful misconduct, so some of this may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless FrankVenture LLC and its members, managers, officers, employees, agents, licensors and service providers against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees), including for injury to or death of any person or loss of or damage to any property (including any vessel), arising out of or relating to: (a) your use of the Service; (b) your breach of these terms or of any law; (c) your violation of anyone else’s rights; or (d) any decision you make, or fail to make, based on the Service, including any go/no-go decision. This survives the end of your account.

Ending it, and the fine print

Stop using the Service whenever you like. We may suspend or end your access if you break these terms or to protect the Service. The parts that should outlive the account do: reference-use-only, the warranty disclaimer, the limitation of liability, the indemnity, and governing law. These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction and venue of the state and federal courts in Dallas County, Texas for any dispute not otherwise agreed. If any provision is unenforceable the rest stand. This document is the entire agreement between us about the Service. We may update it. We will email you about material changes at least 30 days before they take effect, and other changes take effect when posted with a new effective date.

What changed on September 27, 2026

Version 2026-09-27 replaces version 2026-09-25. This is every change since version 2026-08-17:

• What an assessment describes. The day score and every assessment describe how the conditions fit the limits you set. They describe fit, not safety.
• Planning figures, charts and harbor information. Distances, times and routes are for planning, and charts shown in the Service are for reference, not for navigation. Places to get in along a route come from open map data and may be incomplete.
• Data can be delayed or incomplete, and a forecast is a forecast whoever publishes it.
• The first charge after a trial. The trial terms now give its date, the day the trial ends, and how to avoid it. We email you at least 15 days before each renewal.
• Limits on liability. The document now says that some jurisdictions do not allow the exclusion or limitation of liability for personal injury, death, gross negligence or willful misconduct, so some of that section may not apply to you.
• Float plans are not monitored, and the document says so. GoNoGo WX Boating does not watch your trip and never contacts anyone if you are overdue; your shore contact does, and check-in reminders go by email and can be late or fail to arrive.
• The logbook is gone. The product no longer keeps a logbook, so it is no longer listed among what you can download or what a deletion erases.
• Refunds are stated plainly. Your first charge is not refundable, so the free days are the time to decide; a renewal charge that takes you by surprise is still refunded if you write within 14 days.
• Material changes. We will email you about material changes at least 30 days before they take effect, rather than treating continued use as acceptance.
• “Act for us under contract” is restored. Stripe, Resend, PostHog, Anthropic and Cloudflare act for us under contract.
• Global Privacy Control. We treat it, like Do Not Track, as a no to analytics.
• Page counts by our host are disclosed. Cloudflare’s cookieless page counting runs for every visitor, and the cookie section now says so, what it records, and that your IP address reaches Cloudflare so it can tell your country.
• Boating only. GoNoGo WX now sells one product, GoNoGo WX Boating. Everything about flying came out: the pilot-in-command clause, the FAA briefing, NOTAMs, METARs and TAFs, Air Traffic Control, aviation weather as a source, and the sentence about products sold separately. Where the liability and indemnity clauses named an aircraft, they now name only a vessel.
• One subscription, and its price is stated. It is annual, at $149 a year, and a subscription started through 11:59 pm Eastern, October 30, 2026 pays $99 for its first year. The monthly plan is withdrawn. Renewals are $149 a year rather than “the then-current price”, and if we change the price we will email you at least 30 days before the renewal it applies to.
• One free trial per person and boat. The trial terms say so, and the privacy and cookie sections describe the scrambled boat fingerprint and the device cookie that keep it fair, why we keep them, and for how long.
• The free trial is described. 7 days, no card, and what happens when it ends: your boat, limits and saved places are kept; briefings, planning and alerts pause until you subscribe; check-in reminders for a float plan you already sent keep going.
• What we collect now also lists float plan details (the people aboard and your shore contacts’ names, phone numbers and emails), your usual crew list, what identifies your boat (MMSI, registration number, a photo link), your saved trips, your Virtual First Mate questions, and the record of your agreement to the automatic renewal (when, what you were shown, and the IP address and browser). It says that you confirm the people you name have agreed to be named and emailed, and that a float plan with an MMSI links to VesselFinder. The list no longer claims a count.
• Analytics no longer sets a cookie. It uses a random identifier in your browser’s local storage, counts on our own server, still only with your consent, and turning analytics off erases the identifier.
• Every provider is named. The list now includes Anthropic, Stripe, OpenStreetMap’s place search, the Army Corps of Engineers channel data hosted by Esri, NOAA’s radar service, and our own error monitoring, and says what each one receives.
• Download and delete are self-serve from Settings, and the document says what outlives a deletion for a short while: cached briefings (30 days), open counts (90 days), and a float plan you sent (7 days after the time it says to treat the boat as overdue).
• Sharing a briefing is a new section: forward a briefing or share its link with a few people who have a real interest in the trip, and a shared link opens for at most 3 people.
• If we discontinue the Service is a new section: at least 30 days’ notice, and a refund of the unused part of what you paid, without being asked.
• Where the data comes from now names the main sources and points to Data sources for the ones whose licenses require credit.
• Smaller wording changes: the safety notice says the Service “reports” GO, CAUTION or NO-GO rather than “suggests” it, and “reads” became “briefings” throughout; the emergency line adds VHF channel 16; and the contact line reads “Write to”.

Earlier revisions. On August 17, 2026 the Subscriptions section first stated the automatic renewal in full, and the refund sentence changed so that a renewal charge that surprises you is refunded if you write within 14 days. Before August 16, 2026 there were three documents: Terms of Service, a Privacy Policy and a Cookie Policy. They are now one, at this address, and the old links redirect here. Through all of it, we never sell your information.
