Terms of Service

Please read these terms carefully before using the Service.

These Terms of Service (“Terms”) are a legally binding agreement between you (“you”) and FrankVenture LLC (“FrankVenture LLC”, “we”, “us”), owner and operator of GoNoGo Weather and the websites, apps, and services we offer at gonogowx.com(the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. You must be at least 18 years old to use the Service.

Safety notice

GoNoGo Weather is a decision-support tool for reference and situational awareness only, not a guarantee of safety and not a navigation system. It combines public weather data with limits you set to produce a GO / CAUTION / NO-GO suggestion. Weather and aeronautical data can be inaccurate, delayed, incomplete, unavailable, or improperly formatted, and conditions change rapidly.

The Service must not be used as a primary means of navigation or as the basis for any course, heading, altitude, routing, or maneuvering decision. Fly, sail, and travel using your certified avionics, official charts, instruments, and your own observations. The Service is not intended for any use in which its failure or inaccuracy could lead to death, personal injury, or property or environmental damage.

You are always solely responsible for your own go/no-go decisionbased on all available information, official sources, your training and experience, your equipment, and your personal risk tolerance. A “GO” is never permission to proceed, and a “NO-GO” is never an instruction. The Service is not a substitute for official sources: NWS / NOAA forecasts and marine warnings, a Flight Service weather briefing, NOTAMs, METARs/TAFs, Notices to Mariners, ATC, or the judgment of a qualified professional. Always consult them and comply with all applicable laws and regulations (including the Navigation Rules / COLREGS and the Federal Aviation Regulations). In an emergency, contact 911, the U.S. Coast Guard, or Air Traffic Control as appropriate.

1. The Service

GoNoGo Weather provides marine, aviation, and outdoors weather go/no-go assessments tuned to thresholds you establish. We may add, change, or discontinue features at any time. The verticals are offered as separate subscriptions; access to one vertical does not grant access to another unless you hold a bundle or comped plan.

2. Reference Use Only; No Navigation; Assumption of Risk

The Service, and all data, reads, outlooks, decoded reports (including METARs, TAFs, PIREPs, and SIGMETs), diagrams, and content it provides, are for reference and situational awareness only. They are not certified for navigation, are not a substitute for your own best judgment in any given situation, and must be used in conjunction with appropriate official charts, publications, briefings, and instruments.

Aviation. If you are a pilot, you are the pilot in command and are solely responsible for the safe operation of the aircraft and for compliance with all Federal Aviation Regulations, including obtaining all information required by 14 CFR 91.103 before each flight. The Service does not by itself satisfy any preflight, weather-briefing, or NOTAM requirement; it is not an official weather briefing and is not FAA-approved for navigation. Verify the active runway, current conditions, NOTAMs, and all critical data through official sources (for example, 1-800-WX-BRIEF / Flight Service, aviationweather.gov, ATIS/ATC) before and during flight.

Marine and outdoors. You are the operator and are solely responsible for the safe conduct of your voyage or activity, for compliance with the Navigation Rules / COLREGS and all applicable laws, and for monitoring VHF weather, marine warnings, local advisories, and your own observations.

You expressly acknowledge and agree that your use of the Service is at your sole risk, and you assume all risk arising from that use and from any decision you make or action you take or fail to take in connection with it.

3. Accounts

You are responsible for safeguarding your password and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use.

4. Subscriptions and Billing

Paid plans are billed in advance on a recurring basis through our payment processor. You may cancel at any time; cancellation stops future renewals and access continues through the end of the current paid period. Fees are non-refundable except where required by law. We may change pricing prospectively with notice.

5. Third-Party Data and Services

The Service relies on third-party data and providers, including the National Weather Service / NOAA, the FAA / aviationweather.gov, Open-Meteo, mapping and geolocation providers, our hosting and email providers, and our payment processor. We do not control, and are not responsible for, the accuracy, availability, completeness, timeliness, or formatting of third-party data, and we do not guarantee that the original sources (including the FAA and the National Weather Service) have provided data that is accurate, complete, timely, or properly formatted for display.

Some information in the Service is drawn from published navigational references, including the US Coast Pilot. Where we do that, we cite the volume and paragraph so you can look it up yourself. We endeavor to work from the most current edition available to us, but editions and weekly corrections are issued on the publisher’s schedule, not ours, and we do not promise that any citation reflects the latest edition or that the underlying reference is current, complete, or correct. Charted conditions change, and shoals, bars and channels move between surveys. Nothing cited here substitutes for current charts, Local Notices to Mariners, or your own judgment.

6. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • use the Service as a primary means of navigation or for any safety-critical or high-consequence purpose for which it is not intended;
  • scrape, resell, or redistribute the Service or its data without permission;
  • interfere with, overload, or attempt to gain unauthorized access to the Service; or
  • rely on the Service as your sole basis for any safety-critical decision.

7. Intellectual Property

The Service, including its software, design, and content, is owned by FrankVenture LLC and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to use the Service for your personal, non-commercial use. The thresholds and data you enter remain yours.

8. Disclaimer of Warranties

THE SERVICE, AND ALL DATA, READS, OUTLOOKS, AND CONTENT AVAILABLE THROUGH IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY READ OR DATA IS ACCURATE, COMPLETE, TIMELY, OR CURRENT, OR THAT THE ORIGINAL DATA SOURCES (INCLUDING THE FAA AND THE NATIONAL WEATHER SERVICE) HAVE PROVIDED DATA THAT IS ACCURATE, COMPLETE, TIMELY, OR PROPERLY FORMATTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FRANKVENTURE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PROPERTY (INCLUDING ANY AIRCRAFT OR VESSEL), PERSONAL INJURY, OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY DECISION YOU MAKE BASED ON IT, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED DOLLARS ($100.00). You acknowledge that this allocation of risk is a basis of the bargain and reflects the fees charged.

10. Indemnification (Hold Harmless)

You agree to defend, indemnify, and hold harmless FrankVenture LLCand its members, managers, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees), including for injury to or death of any person or loss of or damage to any property (including any aircraft or vessel), arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms or any law or regulation; (c) your violation of the rights of any third party; or (d) any decision you make or action you take or fail to take based on the Service, including any go/no-go decision. This obligation survives termination of your account.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including Sections 2, 8–10, 12–13) will survive.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Dallas County, Texas for any dispute not subject to other agreement.

13. Changes; Miscellaneous

We may update these Terms; material changes take effect when posted with a new effective date, and continued use constitutes acceptance. If any provision is unenforceable, the rest remain in effect. These Terms are the entire agreement between you and us regarding the Service.
